Your order for purchase constitutes your "offer" which shall be subject to the terms and conditions. Techorbitonline.ae reserves the right to accept or reject your offer. All fees and prices are in UAE Dirhams (AED). You might see prices/fees in your local currency based on standard currency exchange.

Changing of Prices

Site prices are subject to modification at any time. Prices may also vary due to a launching price, a promotional offer or sales. Prices of items that are not in stock or that are available for a pre-order are valid during its promotional period after the order was placed. Should the price of those items change with respect to the pre-order price, the Customer will be informed and will have the possibility to cancel the order. We reserve the right to update prices displayed on the Site from time to time and once updated, they cannot be claimed against an order that has already been confirmed or delivered.

While Techorbitonline.ae strives to provide accurate product and pricing information, pricing or typographical errors may occur. Therefore, Techorbitonline.ae cannot confirm the price of a product until after you order. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, Techorbitonline.ae shall have the right, at our sole discretion, to refuse or cancel any orders placed for that product, unless the product has already been dispatched.

Orders/Placing an Order

Placing an order can be done from the Site. Should you place the order from the Site, you have to be sure that personal data is correct and updated. We are neither responsible for sending e-mails to the wrong e-mail address nor for sending parcels to the wrong delivery address if the form is incorrectly filled out.

You can expect your order to be processed within 48 hours, provided the items are in stock and there are no problems with payment verification. Orders are not processed on weekends and holidays.

Cancel Orders

In case we receive a cancellation notice and the order has not been processed/approved by us, we shall cancel the order and refund the entire amount. The customer agrees not to dispute the decision made by Techorbitonline.ae and accept Techorbitonline.ae's decision regarding the cancellation.

Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being cancelled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. If your order is cancelled after your credit card has been charged, the said amount will be reversed back in your Card Account. No cash disbursement shall be made under any condition whatsoever.

You agree, understand and confirm that the credit card details provided by you for availing of services on Techorbitonline.ae will be correct and accurate and you shall not use the credit card which is not lawfully owned by you, i.e. in a credit card transaction, you must use your own credit card. You further agree and undertake to provide the correct and valid credit card details to Techorbitonline.ae. Further the said information will not be utilized and shared by Techorbitonline.ae with any of the third parties unless required for fraud verifications or by law, regulation or court order. Techorbitonline.ae will not be liable for any credit card fraud. The liability for use of a card fraudulently will be on you and the onus to 'prove otherwise' shall be exclusively on you.

Techorbitonline.ae reserves the right to recover the cost of goods, collection charges and lawyers’ fees from persons using the Site fraudulently. Techorbitonline.ae reserves the right to initiate legal proceedings against such persons for fraudulent use of the Site and any other unlawful acts or acts or omissions in breach of these terms and conditions.

Invoice

The order form filled out online by the Customer cannot be considered as an invoice. Regardless of the purchase or payment methods, the Customer receives an invoice inside his/her parcel when it is delivered. A digital copy of each invoice is registered in our secure and encrypted database.

Security

We will take all reasonable precautions to ensure the security of any payment details included in your order nevertheless, barring direct negligence on our part, we cannot be held liable for any losses incurred as a result of unauthorized access to the information you may provide. Disputes

If any dispute, claim, controversy or difference (including in relation to any tortious or statutory claim) ("Dispute") arises out of or in connection with or in relation to this User Agreement, including (without limitation) any question regarding the formation, existence, scope, performance, interpretation, validity or termination of this User Agreement or this clause, or any question regarding the legal relationships established by this User Agreement or the consequences of its nullity, then the parties shall first attempt amicably to settle the dispute through good-faith negotiations over thirty (30) calendar days commencing on the date that a party first sends to the other party written notice of the Dispute.

The arbitration proceedings shall be conducted in the English language and the award shall be in English. The foregoing provisions of this clause are without prejudice to the right of Techorbitonline.ae to seek interim relief at any time from any court of competent jurisdiction (whether or not an arbitrator has been appointed) and Techorbitonline.ae shall not be deemed to have breached this arbitration agreement or infringed the powers of the arbitrator for having done so.

Governing Law and Jurisdiction

This User Agreement shall be construed in accordance with the applicable laws of UAE. The Courts at Dubai shall have exclusive jurisdiction in any proceedings arising out of this agreement. Any dispute or difference either in interpretation or otherwise, of any terms of this User Agreement between the parties hereto, the same shall be referred to an independent arbitrator who will be appointed by Techorbit Trading L.L.C. and his decision shall be final and binding on the parties hereto. The arbitration shall be held in Dubai. The laws of UAE shall be applicable in such aspects.

When you visit the Site or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. Warranty

The products displayed on website carry limited warranty from brand / manufacturer / distributor for a limited period against manufacturing defects only.

The terms, conditions, duration of warranty, exclusions of warranty shall be as per warranty card attached with each product. Warranty commences from the date of the Invoice, unless specified otherwise.

Warranty is applicable within the limits of United Arab Emirates only unless specified otherwise in the warranty card or on Website. Techorbit Trading L.L.C will only be the facilitator of this service and primary responsibility for warranty service rests with the brand / manufacturer / distributor. In case the product is defective and/or requires repair, it is your responsibility to deliver the product, at your cost, to any of our Techorbit Showrooms and Service centres in the United Arab Emirates.

In cases of Dead on Arrival (DOA) product / Out of the Box failure, the respective service centre / service provider will determine whether the product is DOA and would offer either a replacement or product repair.

Other than what is provided by the brand / manufacturer / distributor, we hereby expressly disclaim any warranties or representations (expressed or implied) in respect of quality, suitability, accuracy, reliability, completeness, timeliness, performance, safety, merchantability, fitness for a particular purpose, or legality of the products listed or displayed or transacted (including product information and/or specifications) on the Website.

Exclusions:

• Damage caused by breaking the device intentionally and unintentionally.
• Damage caused by fire, natural disaster, or loss of left of the device.
• Instruments repaired at an unapproved service center.
• Instruments of which the serial number were changed or removed in whole or in part.
• We reserve the right to obtain an independent assessment and valuation report in the event of any claim.

Feedback

You may have the opportunity to provide reviews, suggestions, ideas, and feedback, (hereinafter, collectively, “Feedback.”) Should you so provide such Feedback you grant us sole ownership of the same, which includes without limitation the right for us or any Third Party we designate, to use, copy, transmit, excerpt, publish, distribute, publicly display, publicly perform, create derivative works of, host, index, cache, tag, encode, modify and adapt (including without limitation the right to adapt to streaming, downloading, broadcast, mobile, digital, thumbnail, scanning or other technologies) in any form or media now known or hereinafter developed. All such Feedback shall be treated as non-confidential.

If it is determined that you retain moral rights (including rights of attribution or integrity) in the content submitted by you, you hereby declare that: (a) you do not require that any personally identifying information be used in connection with the content, or any derivative works of or upgrades or updates thereto; (b) you have no objection to the publication, use, modification, deletion and exploitation of the content by us or our licensees, successors and assigns; (c) you forever waive and agree not to claim or assert any entitlement to any moral rights of an author in any of the content; (d) you forever release us, and our licensees, successors and assigns, from any claims that you could otherwise assert against us by virtue of any such moral rights. LIMITATIONS OF LIABILITY

IN ALL CIRCUMSTANCES TECHORBITONLINE.AE MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD TECHORBITONLINE.AE SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. TECHORBITONLINE.AE SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT TECHORBITONLINE.AE HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.

If you are dissatisfied with the Site or any content or materials on it, your sole exclusive remedy is to discontinue your use of it. Further, you agree that any unauthorized use of the Site and its services as a result of your negligent act or omission would result in irreparable injury to Techorbitonline.ae and we shall treat any such unauthorized use as subject to the Terms.

Products deemed to be super-savers or highly discounted by the company might be limited by quantity per order and the company reserve the right to alter the ordered quantity for such products and or cancel the order with or without the consent of the customer.

We reserve the right to cancel any unpaid order under any circumstances without any owed liability towards the customer or otherwise, in case of paid order we still reserve this right as long as paid amount is returned in full.

Intellectual Property

All content included on the Site, such as text, graphics, logos, images, audio clips, video, data, music, software, and other material (collectively "Content") is owned or licensed property of techorbitonline.ae or its suppliers or licensors and is protected by copyright, trademark, patent, or other proprietary rights. Governing Law and Jurisdiction
